Breckenridge Responsible Agent
As defined in the Ordinance enacted by the Town, a Breckenridge Responsible Agent (or Breckenridge Alternate Responsible Agent) has the following general responsibilities:
[The] responsible agent, or such person’s employee or designee, shall be available twenty four (24) hours per day, seven (7) days per week, to respond (as defined in the administrative rules and regulations) to any complaint filed with or through the Town, or a website provided by the Town for such purpose, about the operation or condition of the licensee’s accommodation unit. Such responsible agent shall respond to a complaint within sixty (60) minutes of receiving notice of such complaint.
The accompanying Administrative Regulations from the Town of Breckenridge further provide that "a proper response to a complaint may also require the responsible agent... to visit the accommodation unit if such action is necessary to attempt in good faith to eliminate the problem that was the subject of the complaint."

Dillon Responsible Agent
As defined in the Ordinance enacted by the Town, a Dillon Responsible Agent has the following general responsibilities:
[The] responsible agent is the owner, the owner’s agent, or the owner’s designee who is available to respond to any issues arising from a short-term rental unit within sixty (60) minutes and who is authorized to receive written notice on behalf of the owner.
Staff members for the Town of Dillon have advised Summit Local Agent that they will be drafting a set of administrative regulations to allow more clarification regarding the precise responsibilities for any person or company serving as a Dillon Responsible Agent. As the Town formulates these administrative regulations, Summit Local Agent may have an opportunity to potentially submit feedback. Otherwise though, we will closely monitor the regulatory process, and we will adjust to any new requirements that the Town of Dillon eventually creates.

Frisco Responsible Agent
Section 110-37 of the Frisco Short Term Rental Ordinance defines a Frisco Responsible Agent as “a management company or individual who is… available 24 hours per day, 7 days per week to respond as the initial point of contact for the short-term rental property.”
As part of its licensing process, the Town states that a Frisco Responsible Agent must be designated for every short-term rental property. Additionally, the Town requires information notices to be placed in each short term-rental unit, and those notices must reference contact information for the Frisco Responsible Agent as well.
In a memorandum by Town staff accompanying the Ordinance, they noted concerns had been voiced “relating to the vagueness of ‘responsible agent’ requirements, in particular the lack of a measured response time.” The Town of Frisco's staff also provided the following explanation:
[a]dditional concerns include the ability of owners to name alternate “responsible agents” (an option not currently provided for in the ordinance) and a lack of specificity in relation to the overall complaint submittal and resolution process. Staff met internally with the Police Department to discuss the complaint process shortly before the Council meeting on November 13. Police Department staff indicated a separate call center to field initial complaints would be helpful in allaying the burden on dispatch personnel. Staff believes that the concerns raised above can be more properly handled with well-communicated administrative policies, rather than through updates to the officially codified ordinance.
In comments made to Town Council, Frisco's staff stated that it would begin work as soon as possible to draft these new administrative policies. As a result, while the Town mandated the designation of a Frisco Responsible Agent as part of its ordinance, more detail on the precise responsibilities will be forthcoming. At present, Frisco is implementing its Ordinance on the following timeline:
- June 3, 2019 – Short term rental license application available online
- Starting July 1, 2019 – Short term rental licenses issued by Town of Frisco
- August 2019 – Formal complaint process to be communicated by Town of Frisco
Once granted by the Town, the initial Frisco short term rental license period will run from July 1, 2019 to April 30, 2020.

Silverthorne Responsible Agent
As stated in the Ordinance enacted by the Town, a Silverthorne Responsible Agent (or Silverthorne Alternate Responsible Agent) is defined as follows:
an individual who is available for immediately responding to any issues arising from the Short Term Rental Property 24 hours per day, 7 days per week.
Each Silverthorne short-term rental property owner must designate a Responsible Agent. The Town is establishing a call center hotline to receive complaints regarding short-term rentals. When the call center receives an initial complaint concerning a Silverthorne short-term rental, it shall be directed to the Responsible Agent. The Ordinance states that the "Responsible Agent shall resolve the issue that was the subject of the complaint within sixty (60) minutes, or within thirty (30) minutes if the problem occurs between 11:00 p.m. to 7:00 a.m., including visiting the site if necessary."
The Town Ordinance generally requires that the Silverthorne Responsible Agent “respond to and attempt to address in good faith the issue that was the subject of the complaint….” If, despite good faith efforts, the problem that was the subject of the complaint cannot be eliminated, the Responsible Agent must immediately contact Police Dispatch, and follow any directions given to the agent by the dispatcher. When the Silverthorne Responsible Agent (or Silverthorne Alternate Responsible Agent) believes that the complaint has been successfully eliminated, they must promptly notify the Town’s call center. If the Town’s call center does not receive notification from the Silverthorne Responsible Agent that the complaint has been successfully eliminated within 60 minutes (or within 30 minutes if the problem occurs between 11:00 p.m. to 7:00 a.m.), it shall be presumed that the complaint was not successfully eliminated. If a complaint is not eliminated to the satisfaction of the complaining party, that party may file a formal complaint with the Town. If the Town thereafter finds a violation occurred, potential penalties for the short-term rental owner include fines and suspension or revocation of the their license.

On Dec. 18, 2018, the Board of County Commissioners enacted Summit County Short-Term Regulations, which apply solely to unincorporated areas of Summit County such as Dillon Valley, Summit Cove, Keystone, Wildernest and Copper Mountain. If your short-term rental property is located within the official town boundaries for Breckenridge, Dillon, Frisco or Silverthorne, the short-term rental ordinances enacted by each of those towns would instead apply. In the unincorporated portions of Summit County, the Regulations define a Summit County Responsible Agent as follows:
a person or company... [who] shall be available 24 hours per day, 7 days per week to respond to potential issues and violations related to this Code.
Each short-term rental property owner must designate a Summit County Responsible Agent as part of the process of obtaining their permit. An owner can designate themselves as Responsible Agent. However, the County is establishing a call center hotline to receive complaints that arise for short-term rental properties. When someone submits an initial complaint concerning a Summit County short-term rental, it will be directed to the Responsible Agent for the property at issue. And, a Summit County Responsible Agent must be able to affirmatively respond to complaints within one hour of notification. As part of that response, the Regulations also expressly require that the Responsible Agent shall "respond to the complaint, including visiting the site if necessary."
If an initial complaint is not resolved, a formal complaint may be filed with the Summit County Planning Department. The County will provide the Complaint to the short-term rental owner or Responsible Agent, and it will investigate. If violations are not corrected or if there are repeat offenders, Summit County will then pursue more formal action. Penalties include the possibility of suspension or revocation of a short-term rental permit.
While crafting the new Regulations, the Board of County Commissioners also added a new requirement, which was not previously enacted by the local towns. If a fire ban occurs in Summit County, the Regulations require a Responsible Agent to notify renters of the current fire restrictions and provide instructions on how to access the Summit County Alert System for real-time information during their stay.
